Abstract
    The Erika and Prestige oil spills rekindled the debate about how the international liability compensation regime works for damage caused by oil pollution and on the role that it could play in preventing them. This publication presents the main outputs of a research project devoted to these two issues. It examines the difficulties in compensating damage from spills, through an analysis of major disasters which have occurred in Europe in the past thirty years. It shows the special way the international compensation system attributes the social cost of oil spills to the responsibility of the various stakeholders involved in shipping of oil and examines how it could act as a tool for prevention. Finally, the work highlights the numerous interactions between countries in terms of pollution risk management and looks at their consequences on the current form of the international regime and its effectiveness in preventing pollution. It will interest both French and foreign research scientists and anyone concerned by accidental marine pollution.
